What are "Three Illegal Acts" Foreigners
This term refers to foreigners who enter into or stay in China illegally, or who work in China without work permission (hereafter referred as “Three Illegal Acts” Foreigners).

What are the legal consequences for foreigners working ineligibly in China?
According to the Exit and Entry Administration Law of the People’s Republic of China, maximum fines on illegally employed foreign nationals are increased from RMB 1,000 to RMB 20,000. In “serious circumstances”, illegally employed foreign nationals may be detained for 5-15 days, or even deported and barred from entering China for up to 10 years.
This is stated in Article 80 of The Exit and Entry Administration Law of the People’s Republic of China: Foreigners who work in China illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000 yuan; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 yuan but not more than RMB 20,000 yuan.
Foreigners who hold a work permit and/or a work-type residence permit take a part-time job.
What are the penalties for part-time employers and employees deliberately violate the law?
According to the Exit and Entry Administration Law of the People’s Republic of China, persons who introduce jobs to ineligible foreigners shall be fined RMB 5,000 yuan for each job illegally introduced to one foreigner, with a cap of not more than RMB 50,000 yuan in total. Entities that introduce jobs to ineligible foreigners shall be fined RMB 5,000 yuan for each job illegally introduced to one foreigner, with a cap of RMB 100,000 yuan in total; and any illegal gains shall be confiscated.
Maximum fines on employers that illegally employ foreign nationals are increased from RMB 50,000 to RMB 100,000. Individuals or entities that illegally employ foreigners shall be fined RMB 10,000 yuan for each illegally employed foreigner, with a cap of RMB 100,000 yuan in total. Any illegal gains shall be confiscated.
In other words, entities, introducers or individuals who illegally employ foreigners, as stated in the ineligible employment conditions, shall receive different levels of punishment determined by the severity of the circumstances.
